Most business owners (hopefully), realise their obligations under the Business Names Act 1962.

However, are you reading the fine print?

When you apply for your business name, the QLD Office of Fair Trading provides this disclaimer....
"When you apply to register a business name we do not check:

• interstate business names
• similar company names
• registered trademarks (we do not have rights under the Business Names Act 1962 to check this, so you need to do a search)".

Choosing your “New” Name

How did you think of your new businesses name? Did you:

• spot an amazing name on holiday and bring it home?
• change your competitors name a little bit?
• coin a new, unique name for your business.

I hope the last example applies to you. If not, you must be aware that you are potentially liable for breach of the Trade Marks Act, the Trade Practices Act and the Tort of Passing Off.
